By using our website and purchasing products from Fusion Tenders, you affirm that you are at least 18 years old and have the legal capacity to enter into these Terms and Conditions. If you are using the site on behalf of an entity, you represent that you have the authority to bind that entity to these terms.

2. Products and Services

​

Fusion Tenders offers lightweight boats manufactured using the vacuum infused resin method as well as associated accessories. We strive to provide accurate descriptions and pricing of our products.

3. Orders and Payment

​

  • Ordering: By placing an order, you agree to pay the deposit price indicated at the time of your invoice and pay the remaining balance on completion of the product and prior to delivery, if applicable.

  • Payment Methods: Cash, bank transfer, cheque.

4. Shipping and Delivery

​

  • We aim to process and ship orders promptly. Delivery times may vary based on location and availability of products. Fusion Tenders is not responsible for delays caused by shipping carriers or other unforeseen circumstances.

  • The buyer has the right to inspect the product at the factory prior to final payment. 

  • If any undisclosed defects are discovered, the buyer has the right to bring them to the attention of Fusion Tenders, where the defects will be rectified.

5. Refunds and Returns

Please refer to our Refund Policy for information about returns, exchanges, and eligibility for refunds. By purchasing our products, you agree to follow the guidelines outlined in the refund policy.

6. Warranties and Disclosures

​

  • Fusion Tenders warrants that they are the legal owner of the tender and have the right to sell this product.

  • Fusion Tenders provides a 12-month warranty against any structural defects which have been identified as having
    occurred during construction.

7. Intellectual Property

All content on the Fusion Tenders website, including text, graphics, logos, images, and software, is the property of Fusion Tenders or our licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

8. Title and Registration


Fusion Tenders agrees to transfer a clear title to the Buyer upon full payment. The Buyer is responsible for any registration,
taxes, or transfer fees required by law.

9. Limitations of Liability

​

To the fullest extent permitted by law, Fusion Tenders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website, including but not limited to loss of profits or revenue. ​

10. Risk of Loss


Risk of loss or damage to the tender remains with Fusion Tenders until the Buyer takes possession upon full payment.

11. Default and Termination

 

  • By accepting the invoice for your product, you agree that if you wish to cancel the order once the construction of the tender has began, Fusion tenders has the right to retain the deposit.

  • If Fusion Tenders fails to deliver the tender, the Buyer may seek a refund or legal remedies.

11. Changes to Terms and Conditions

Fusion Tenders reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our website after any changes will constitute your acceptance of the new terms.
